REGULATION
This Regulation defines the rules and conditions for
the performance of services byFORCZEK TRANS EUROPE.It also
applies to the rules ofliability for non-performance or improper
performance of the ordered services.The Regulations apply to
customers,FORCZEK TRANS EUROPEemployeesand entities
cooperating with FORCZEK TRANS EUROPEin the performance of
services.

The scope ofFORCZEK
TRANS EUROPE'sactivitycovers theareas of Poland,
theCzech Republic, Slovakia, Germany, the Netherlands, Belgium,
France,EnglandandIreland.FORCZEK TRANS
EUROPEprovides services to legal persons as well as organizational
units without legal personality.FORCZEK TRANS EUROPEreserves
the right to transfer transport orders to external companiesand
cooperating entities.
§1.Definitions:
For the purposes of these Regulations, the terms used
below mean:
Price list- a list of service fees,
Customer- respectively: the sender, the recipient,
Courier- a person acting on behalf of and forForczek
TRANS EUROPE, performing for clients part of the service, the
curtainsAdach specified in the rules,
The place of delivery- indicated by clientplace of Parcel
delivery,
Sender- the personwho delivers the parcel to the
courier,
Recipient- the entity indicated in the document to whom the parcel
is to be delivered at the place of delivery,
Shipment- items packed in the required or customary manner,
ordered by the Customer for acceptance, transport and delivery,
Order- theorder of the client who sent the completed form

§2.Conclusion
and terms of the contract for the Provision of Services:
- The
contract for the provision of the service isconcludedwhenFORCZEK
TRANS EUROPE accepts theparcelfor transport and
delivery.Byplacing an order,
thesenderautomatically confirms that he has read the content
of these Regulations and that he accepts all its provisionsand
conditions, which thus become an integral part of the concluded
contract;moreover, he declares that the contents of the package are
correct and consistent with the actual state.
- The
courier collecting the parcel is not authorized to make or accept changes
or additions to the conditions specified in the Regulations.
§3.Obligations and
liability of the carrier:
- The
carrier is obliged to collect the shipment from the sender and deliver it
to the recipient as part of the service.
- The
carrier undertakes to deliver the shipment to the recipient within7
working days from the date of departure.
- The
carrier reserves the right to extend the duration of the service for
reasons not attributable to the carrier.
- The
carrier is responsible for the loss, shortage or damage to the shipment arising
from its acceptance for transport until delivery (release), as well as for
delay in performing the service.
- The
carrier is not liable for damage caused as a result of non-performance or
improper performance of the service, consisting in the loss of benefits,profits
or income, both from thecustomer and third parties.
- In a
situation where the damage occurred between the moment the subcontractor
accepted the shipment for transport and the moment it was delivered to the
recipient,FORCZEK TRANS EUROPEis obliged to take all
steps to enable the client to pursue claims from persons participating in
the execution of the order.As part of the above obligation,FORCZEK
TRANS EUROPEsubmits a complaint to the subcontractor in the
manner and within the time specified in the subcontractor's regulations,
attaching all the necessary documents, at the same time informing the
advertiser about the method and date of its settlement.
- The
carrier is not liable if the loss, partial loss or damage to the shipment,
or the delay in the provision of the service arose in particular:
- for
reasons attributable to the sender or recipient, or a third party they
used, not caused by the fault of the carrier,
- from
the properties of things to be moved,
- due to
force majeure, weather conditions,
- from
sending by the sender of things that the carrier, in accordance with the
provisions or regulations, does not accept for transport,
- due to
the lack, insufficiency or defectiveness of the package (shipment)
packaging, thus exposed to damage,
- from
insufficient or inaccurate labelling of the package (shipment)
- due to
the particular susceptibility of the items being moved to damage due to
defects or their natural properties
- The
carrier is not responsible for the loss of the shipment, the weight or
number of items contained in it was not checked at the time of
receipt,if he delivers it without any signs of tampering with the
packaging and permanent security features such as tape, seal, wax seal or
other.
- The
carrier is liable only for actual, proven losses incurred by the Customer
as a result of non-performance or improper performance of the service
- Shipments
that are not properly adapted to transport may not be picked up by the
courier.
- By
orderingFORCZEK TRANSEUROPEservice, the customer
agrees to provide services based on the provisions of the
Regulationsconstituting general terms of contracts within the
meaning of theprovisions of the Civil Code.The client changes
the service instruction only in writing or electronically.In such a case,FORCZEK
TRANS EUROPEreserves the right not to deliver the parcel on time
and to charge a fee.
- If the
carrier determines at any stage of transport of a given parcel that it is
damaged and its damage may destroy adjacent parcels (for example by liquids
leaking from its interior or broken glass), we reserve the right to unpack
and repack the undamaged items for a new one. cardboard box.In this
case, photos of the package and its contents are taken and a destruction
protocol is written.The package isclearly marked so that the
customer is aware of our actions.
- Applies
to collections from Poland -Our tripsare organized every week,
according to thedepartureschedule.Depending on the
route,weleaveour company headquarterson Thursday
or Friday.In order toguarantee that theservice will be
provided in a given week, it should be taken into account that parcels
should be posted from Monday to Wednesday at the latest(excluding
holidays), so that they can reach us at the warehousebefore
our cars leave.If the parcel is posted later, it will be
automatically delivered one week later.
- To book
a seat for transport services such as the transport of animals / cars /
machines / removals, you must pay a deposit, the amount of which you will
be informed by the employees when placing the order. In case of cancellation of transport, the deposit is non-refundable.
- Express
package PL- IRL + € 20 * (delivery in Ireland on the day of departure from
the ferry - usually Monday).
IRL- PL express parcel + 20 € * (shipment from the warehouse in Poland on Monday
with delivery on Tuesday /
personaldoortodoordeliveryon the same week
along the route).
§4.Client's
obligations:
- The
sender is obliged to hand over the parcel to the carrier in a condition
that enables the proper performance of the service and delivery of the parcel
without loss or damage.
- The
sender ensures and warrants that:
- the
package has been properlylabelled, the recipient's address
has been accurately and legibly filled in, the sender's and recipient's
telephone numbershave been provided, thepackageshave
beenmarked with thecorrect address details,the actual
dimensions and weight of the shipments have been provided.ForczekTrans
has the right to verify your shipment in terms of dimensions, weight or
type of packaging at every stage of transport and to add surcharges in
the event of non-compliance.Any additional payment will be charged
after the shipment is delivered to the carrier's warehouse.If the
declared valuesin the formdo not coincide with the actual
dimensions of the shipment, and the package has already been paid in
advance by bank transfer orDotPay- the customer will
receive information about the amounttobe paid.It
will be enforced during delivery in Ireland or cash on delivery in Poland
upon receipt of the parcel by the addressee.
- the
package has been properly packed in a way that protects it against loss,
defect or damage and allows it to be delivered to the recipient without
loss or damage,
- the
contents of the package do not constitute items excludedfrom
services, in accordance with§5paragraph of
theregulations,
- the
sender is liable to the carrier for damage caused to persons, equipment
for other shipments, as well as for any costs resulting from the
defective condition of the package, lack of or defective packaging, or
improper loading operations,
- The
sender is responsible to the carrier for improper filling in the
documents on the basis of which the service is to be performed, including
entering data that is inconsistent with reality, inaccurate, incomplete
or entered in the wrong places.
- The
sender is obliged to return the parcel in thepackage.The
packaging should meet the criteria availablein the guide packed
parcels available at:

- When
placing the order, the customer is obliged to provide the carrier with the
following information necessary to perform the service:
- sender's
data: company name or name and surname of the sender,
- sender's
address, including zip code,
- contact
telephone number to the sender,
- date
of shipment (if not givenin thenotestaken is the
nearest possible date-in Poland, following receipt of
parcelsthatthe next working day(Mon to
Friday)after placing the order, the Irishdriver arranges
individually collection / delivery ofup to 7 daysfrom the day
of departure.
- email
to which thegeneratedconsignment note will be sent.
Afterthereceipt
ofit customeris obligatedto print and stick it on the
parcel / package.In the event of its absence, the courier has the right
to refuse to accept the service request.If the customer does not have the
option of printing and sticking the consignment note from the e-mail, one have
to select the option I cannot print – I
order courier with the letter + 5 € extra
when placing the order, as it guarantees the arrival of the courier with
his own letter.
Note: It is the
original bill of lading that should accompany the shipment during transport.It
is proof of the contract of carriage, so it is a very important document, e.g.
when making claims!
- recipient's
data: company name or name and surname of the recipient,
- recipient's
address, including postal code,
- contact
telephone number to the recipient,
- the
number of packages and the weight of the shipment, exact dimensions
according to the formula:

§5.Items excluded from
services:
The companyForczekTrans Europedoes not accept for transportation and delivery of
packages:
- items
the transport of which is prohibited on the basis of legal provisions or
agreements, conventions or international agreements to which Poland is a
party,
- cash,
money stamps, vouchers and other payment documents, checks, payment and
credit cards, excise tax forms, securities, metals and precious stones
and products made of them, jewelery,
- flammable
and explosive materials, caustic substances,
- weapons and ammunition,
- drugs, psychotropic and hallucinogenic
substances,
- perishable things,
- alcohol, tobacco products,
- Note:sending
alcohol and tobacco products is strictlyprohibited.An attempt
to send it may result in confiscation and a penalty.
ForczekTrans Europecharges
the sender or recipient of such ashipment with a penalty in the
amount of -1000€plus additional costs resulting
from the attempt to transport prohibited items, such as customs service
penalties,failure to pay a penalty results in the case being
brought to court,
- Electronic
equipment transported without original packaging with any fillers
(polystyrene, other manufacturer's protections) orpacked
collectively is not subject to insurance and is transported only at the responsibility
of the sender / recipient,
- Glass
and ceramics transported in packages are not insured (jars, glasses,
lamps, sinks, plates, etc.)
- Any
liquids transported in packages and damage caused by their leakage in
packages are not covered by insurance.
§6.Reward:
- The
amount of remuneration for the provision of the service is specified in
the price list.The current price list is available for each
customer on the website:https://www.forczektrans.com FORCZEK TRANS EUROPEreserves the right to make changes to the price
list, which will apply one week from the date of its publication on the
website.
- Payment
for shipments is made according to the valid price list and
contract.Payment terms and forms are agreed each time with the
sender.
- The
sender is responsible for the reasonable costs and expenses incurred
byFORCZEK TRANS EUROPE(including storage costs) for
losses, taxes, customs duties, penalties, fines and others thatFORCZEK
TRANS EUROPEmay incur and for claims raised againstFORCZEK
TRANS EUROPE, due to the parcel fails to meet any of the
restrictions, requirements or declarations set out in these regulations
or due to the refusal or suspension of services or the return of the
shipment byFORCZEK TRANS EUROPE(or the subcontractor)
in accordance with these regulations.
§7.Complaints:
- In the
case of damage or loss of the parcel, the representative ofFORCZEK
TRANS EUROPEis obliged to write a report in the presence of the
recipient, including the date and time of delivery and a description of
the damage or loss of the parcel.A properly prepared report (signed
by the recipient and the representative of FORCZEK TRANS EUROPE)
is the basis for accepting the complaint.
- Claims
for improper performance of the contract for the provision of services
shall expire as a result of accepting the shipment without
reservations.However, this does not apply to claims for defects or
damage to the shipment that were not visible at the time of
delivery.The carrier's liability in such a case occurs only if the
customer proves that the damage occurred during the time from accepting
the shipment for transport until its release.
- Complaints
for non-performance or improper performance of the contract for the
provision of services may only be submitted by the customer who
commissioned their performance.Complaints submitted by other
persons will be returned to them with an instruction on the person
authorized to submit the complaint.
- Complaints
should be submitted by e-mail toforczektrans@gmail.comwithin 2 (two) days from the date
of delivery, and in the event of loss of the shipment - within 14
(fourteen) days from the date of receipt of the shipment by the carrier
for transport, under pain of losing the right to possible claims.
- If the
complaint is submitted by a person other than the customer who ordered
the service, he should attach a document of the transfer of rights or a
power of attorney.
- After
reporting the damage or loss of shipment, the customer should provide all
documents necessary to carry out the complaint process within 14
(fourteen) days from the date of filing the complaint.
- The
complaint should be considered within 30 days from the date of submission
of the full complaint along with the necessary documents.
- A full
written complaint should include:
- designation
of the company, registered office and address of the complainant as well
as the bank account number to which any compensation should be sent, the
amount of the claim with justification,
- the
basis for the complaint (description of the situation),
- relevant
documents justifying the amount of the claim (original purchase VAT
invoice, bills, receipts or a copy certified to be true to the original,
calculation of production costs, other documents confirming the amount of
the claim),
- a copy
of the report on the condition of the shipment / a copy of the damage
report.
- The
carrier may require the claimant to provide additional documents
necessary to consider the claim.
- In the
event of destruction or damage to the parcel, the complaint should
include photos showing the actual damage to both the packaging (external
damage) of the parcel and its contents (internal damage).
- Complaints
submitted after the deadline, incomplete complaints (not meeting the
conditions set out in point 8 (above), complaints completed after the
deadline or complaints submitted by an unauthorized person are treated as
not filed.
- After
considering the complaint, the carrier shall notify the claimant in
writing or by e-mail about the method of settling the claim, possible
compensation and the date and method of transferring the amount due.
- The
Sender / Recipient is not entitled to deduct the amounts of the claim
against current, past or future receivables.
- Filing
a complaint does not release from the obligation to pay the amount due
for the provision of services byFORCZEK TRANS EUROPE.Failure
to pay may be a reason to reject the complaint.
§8.Privacy policy:
- The
sender, together with the signing of the proof ofpostage,
agrees thatFORCZEK TRANS EUROPE willprocess his
personal data contained in the shipping document and in accordance with
the Act of 29.08.1997 on the protection of personal data, JournalOf
Laws No. 133, item883, necessary for the process ofprovidingservicesbyFORCZEK
TRANS EUROPEand further cooperation.At the same time, the
Sender has the right to inspect and correct their personal data submitted
toFORCZEK TRANS EUROPE.
§9.Account on the website:
- Any
person wishing to order the service can set up an account on the
website.FORCZEK TRANS
EUROPEremains the owner of the accountand reserves the
right to block or delete the account of a person registered on the website,
without giving any reason.Orders placed by using the customer's
login and password will be treated as placed by that customer.
